2. Collection and storage of personal data; nature, purpose and use
If you engage our services, the following information will be collected:
- Salutation, title, first name, surname
- Address
- Email address
- Telephone number (landline and/or mobile)
- Fax number (if applicable and requested)
- Bank account details (if applicable)
In addition, we collect all information necessary to fulfil the contract with you.
Personal data is collected
- to be able to identify you as a customer;
- to be able to provide you with appropriate advice;
- to be able to fulfil our contractual obligations towards you;
- to be able to comply with our legal obligations:
- to correspond with you;
- for invoicing purposes or, where applicable, as part of our debt collection process;
- for the purposes of permitted direct marketing;
- to assert any claims against you.
Personal data is processed in connection with your enquiry to us and is necessary for the purposes stated, namely to process your order and to fulfil obligations arising from the underlying contract. The legal basis for this is Article 6(1), first sentence, point (b) of the GDPR; Article 6(1), first sentence, point (f) of the GDPR.
The personal data collected will be stored until the expiry of the statutory retention period for traders (6, 8 or 10 years after the end of the calendar year in which the contractual relationship ended) and will then be deleted. This does not apply, however, if we are obliged to retain the data for a longer period due to tax or commercial law retention obligations (in accordance with the German Commercial Code (HGB), the German Criminal Code (StGB) or the German Fiscal Code (AO)), or if you have consented to storage beyond this period.
3. Disclosure of data to third parties
As a general rule, your personal data will not be disclosed to third parties. Exceptions to this rule apply only insofar as this is necessary for the fulfilment of contractual obligations with you. This includes, in particular, the disclosure of data to service providers commissioned by us (so-called data processors) or other third parties whose activities are necessary for the performance of the contract (e.g. courier companies or banks). The data disclosed may be used by these third parties exclusively for the purposes stated.
4. Your rights as a data subject
As a data subject, you have various rights:
- Right to withdraw consent: You may withdraw any consent you have given at any time. Data processing based on the withdrawn consent may then no longer be carried out in future.
- Right of access: You may request information about your personal data processed by us. This applies in particular to the purposes of the data processing, the categories of personal data, where applicable the categories of recipients, the retention period, where applicable the origin of your data, as well as, where applicable, the existence of automated decision-making, including profiling, and, where applicable, meaningful information regarding its details.
- Right to rectification: You may request the rectification of inaccurate personal data or the completion of your personal data stored by us.
- Right to erasure: You may request the erasure of your personal data stored by us, provided that its processing is not necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims.
- Right to restriction of processing: You may request that the processing of your personal data be restricted where you contest the accuracy of the data, where the processing is unlawful but you object to its erasure. You are also entitled to this right if we no longer require the data, but you need it to establish, exercise or defend legal claims. Furthermore, you have this right if you have objected to the processing of your personal data;
- Right to data portability: You may request that we provide you with the personal data you have supplied to us in a structured, commonly used and machine-readable format. Alternatively, you may request that the personal data you have supplied to us be transferred directly to another data controller, where this is feasible.
- Right to lodge a complaint: You may lodge a complaint with the supervisory authority responsible for us, for example if you believe that we are processing your personal data unlawfully. Where we process your personal data on the basis of a legitimate interest, you have the right to object to such processing.
